Datasync RMS may offer free trials.
Trial features, duration, eligibility, limits, and availability may change.
A free trial does not guarantee continued access to any particular feature after the trial ends.
Paid plans, upgrades, hardware, optional services, payment processing, cloud services, third-party providers, and other services may involve separate charges.
Pricing and included features are described on the applicable plan, order, quote, or checkout page.
Third-party providers may charge their own fees independently of Datasync RMS.
We may improve, modify, replace, add, remove, suspend, or discontinue features as the product evolves.
We may also release updates, patches, security changes, compatibility changes, or operational improvements.
We work to provide a reliable service, but uninterrupted or error-free operation cannot be guaranteed.
Datasync RMS may include tools designed to assist with taxes, inventory, age verification, labeling, reporting, loyalty, compliance workflows, hemp or THC product operations, and other regulated or business-specific activities.
These tools are provided to assist your operations and do not constitute legal, accounting, tax, regulatory, or professional advice.
You are responsible for determining which laws, taxes, labels, warnings, records, restrictions, and procedures apply to your business.
If a required tax, fee, warning, restriction, or compliance rule cannot be correctly configured or applied, you should stop relying on that affected feature until the issue is resolved.
Reports, dashboards, inventory values, profit calculations, forecasts, loyalty information, and other outputs depend on the accuracy and completeness of the data available to the system.
You remain responsible for reviewing important business decisions and records.
Some features depend on compatible hardware, Windows computers, internet access, email providers, payment processors, cloud providers, cameras, storage providers, or other third-party products and services.
Datasync RMS does not control the availability, pricing, policies, outages, compatibility changes, or performance of third-party services.
Custom development, configuration, integrations, reports, workflows, or other client-specific work may be subject to separate pricing, scope, timing, testing, or written terms.
Datasync RMS software, website content, interfaces, designs, documentation, branding, and related intellectual property remain the property of Datasync RMS or the applicable rights holder.
These Terms do not transfer ownership of the software or underlying intellectual property to you.
You may not use Datasync RMS to intentionally violate law, interfere with service operation, bypass security controls, gain unauthorized access, distribute malicious code, or misuse the service in a manner that harms Datasync RMS, its users, or third parties.
You may not copy or reverse engineer protected components except where expressly permitted by applicable law.
Access may be suspended or terminated for nonpayment, fraud, security concerns, unlawful use, abuse, material violation of these Terms, or conduct that creates unreasonable risk to the service or other users.
To the maximum extent permitted by law, Datasync RMS is provided on an "as available" and "as is" basis.
We do not guarantee that every feature will be uninterrupted, error-free, compatible with every device or third-party service, or suitable for every legal, tax, regulatory, or business requirement.
To the maximum extent permitted by applicable law, Datasync RMS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes lost profits, lost business, lost opportunities, loss of goodwill, or losses caused by third-party services, outages, user error, inaccurate data, or unauthorized access outside our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of the service, violation of these Terms, or operation of your business in a manner that violates applicable law or the rights of others.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
We may update these Terms as the service evolves.
Continued use of Datasync RMS after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
